Terms of Service.

1. Definitions

• Conditions: These Terms of Service as defined herein.
• Booking: The reservation made by a Participant to join a Cycling Tour.
• Fee: The amount paid or payable for participating in a Cycling Tour.
• Cycling Tour(s): The event(s) organized by Us that You register for.
• Rules: Health, safety, and access regulations provided, posted at the Accommodation, or on our website.
• Accommodation: The accommodation provided during the Cycling Tour.
• Equipment: Items supplied by Us for the Cycling Tour.
• We / Us / Our / Organizer / Staff: Cycling Studio SARL, a Swiss Company, located at Rue Viollier 8, 1207 Geneva, Switzerland.
• You / Your / Participant / Rider: The person listed on the Booking participating in a Cycling Tour.
• Deposit: The refundable payment made to secure the Booking of a Cycling Tour. The Deposit is fully refunded if the Booking is cancelled at least 30 days before departure.

2. General Information & Services

2.1 Company Information: BikeTours.cc (the "Website") is operated by the Organizer.

2.2 Our Services: The Website is a platform for discovering and booking premium organized Cycling Tours. Our services include, but are not limited to, multi-day guided Cycling Tours, professional bike rental, Accommodation, logistical support, and technical assistance.

2.3 Acceptance of Conditions: By making a Booking with Us, You confirm that You have read, understood, and agree to be bound by these Conditions.

3. Bookings, Payments & Contracts

3.1 Booking Process: To secure a Booking, You must complete the online booking form, provide valid identification, confirm You are in good health for the chosen Cycling Tour, accept these Conditions, and pay the required Deposit.

3.2 Final Payment: The remaining balance of Your Fee is due 30 days before the start of Your Cycling Tour. If the final payment is not received by the due date, We reserve the right to treat Your Booking as cancelled.

4. Cancellations & Amendments

4.1 Cancellation by You: Should You need to cancel Your Booking, You must notify Us in writing. If You cancel at least 30 days before departure, Your Deposit will be fully refunded. If You cancel less than 30 days before departure, the Deposit is non-refundable, except in exceptional circumstances as defined by applicable consumer law.

4.2 Cancellation by Us: We may cancel a Cycling Tour if the minimum number of Participants is not met or due to force majeure. In this event, We will offer a full refund or an alternative Cycling Tour.

5. Participation & Safety

5.1 Your Participation: You are expected to ride safely, adhere to all laws and Rules, and follow the instructions of Our Staff. We reserve the right to remove a Rider from a Cycling Tour, without refund, if their behavior is deemed unsafe or detrimental to the group.

5.2 Health & Fitness: You are responsible for ensuring You have a sufficient level of fitness for Your chosen Cycling Tour. You must inform Us of any pre-existing medical conditions at the time of booking.

5.3 Equipment & Bike Hire: Wearing a certified cycling helmet is mandatory. If You hire a bicycle from Us, You are responsible for its condition. By using one of our bikes, You confirm that You have the necessary experience, will report malfunctions immediately, will not use it improperly, and accept liability for any damage or theft.

6. Personal Information, Photos, and Videos

6.1 Consent for Personal Information: By making a Booking, You consent to our use of Your personal and health information to manage Your Booking and ensure Your safety.

6.2 Consent for Photos and Videos: By participating, You consent to Us using Your image in promotional materials.

6.3 Withdrawing Your Consent (Opt-Out): You have the right to withdraw your consent as described in clauses 6.1 and 6.2 by informing Us in writing at hello@biketours.cc before the start of Your Cycling Tour.

7. Liability

7.1 Assumption of Risk: By participating in a Cycling Tour, You acknowledge and expressly agree that cycling is an inherently dangerous activity with significant risks. You voluntarily assume full responsibility for any and all risks of injury, loss, or damage, including death, that You may sustain. Consequently, You release the Organizer, its employees, and its agents from any and all liability for any such injury, loss, or damage, except where directly caused by Our proven, gross negligence.

8. Governing Law & Dispute Resolution

These Conditions are governed by the laws of Switzerland. Any disputes arising from this contract shall be subject to the exclusive jurisdiction of the courts of Geneva, Switzerland.
